Ex-South Dakota governor won't have to testify in compact case

A federal magistrate won't force former South Dakota governor Mike Rounds (R) to testify about gaming compact negotiations with the Flandreau Santee Sioux Tribe.

Rounds, who left office on January 8, refused to come to the table so the tribe sued the state for acting in bad faith. But a judge said the circumstances didn't warrant his testimony.

The compact limits the tribe to 250 slot machines. Non-Indian casinos in the state operate nearly 8,300 slot machines.
